1. Acceptance of these Terms

By accessing or using BuildSwap (the "Site"), you agree to be bound by these Terms of Service. If you don't agree, please don't use the Site.

2. What BuildSwap Is

BuildSwap is a free local listings board that helps people post and find surplus or leftover construction materials for pickup — free or for a price agreed directly between users. BuildSwap does not buy, sell, inspect, store, ship, or take possession of any materials. We are not a party to any transaction, exchange, or agreement between users, and we do not verify the identity, claims, or intentions of anyone who posts or responds to a listing.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use BuildSwap.

4. Your Content

When you post a listing, you're responsible for what you post. You agree that any listing you submit is accurate, that you have the right to give away or sell the item described, and that the item is not stolen, counterfeit, or listed in violation of any law.

Listings are public — anyone who visits the Site can see your listing's title, description, category, approximate location, and phone number.

5. Prohibited Items & Conduct

You may not use BuildSwap to post or request:

• Stolen, counterfeit, or illegally obtained materials
• Hazardous materials that require special handling or disclosure under law (e.g. asbestos-containing material, lead paint, unlabeled chemicals) without clearly disclosing the hazard
• Anything illegal to buy, sell, or give away where you or the recipient are located
• Spam, scams, or misleading listings
• Content that harasses, threatens, or targets another person

We may remove any listing, at any time, for any reason, without notice.

6. Meeting & Exchanging Materials

Arrangements to meet, inspect, and exchange materials are made entirely between users, off-platform (by phone/text). BuildSwap strongly recommends meeting in a safe, public location, bringing a friend when possible, inspecting items before taking them, and never sending money in advance to someone you haven't met. You are solely responsible for your own safety and judgment in any exchange arranged through the Site.

7. No Warranty

Materials listed on BuildSwap are offered "as is," with no warranty of any kind from BuildSwap regarding their condition, safety, fitness for a particular purpose, or legality. BuildSwap makes no warranty that the Site will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the fullest extent permitted by law, BuildSwap and its operator are not liable for any injury, loss, damage, or dispute arising from a listing, an exchange between users, or your use of the Site — whether based in contract, tort, or otherwise.

9. Termination

We may suspend or remove your access to the Site, or any content you've posted, at any time.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after a change means you accept the updated Terms.
